Court strikes out breach of trust charges against businessman

A Life Camp Magistrates’ Court in Abuja, has struck out breach of trust and cheating charges preferred against a businessman, Afolabi Olajide

The Magistrate, Hauwa Aboki, struck out the charges and discharged the defendant followed an application by the defense counsel, Lillian Ibrahim that the parties had reached a settlement.

The counsel had prayed the court to strike out the case, as both parties had

reached an out-of-court settlement and that the complainant had lost interest.

The Magistrate said, “Having heard the defense application, the case as a result of lack of interest and settlement reached by both parties in the matter is hereby struck out,”she said
Following the lack of interest and settlement, the court struck out the First Information report (FIR) against the defendant.

According to the charges, Olajide, of New Nyanya, Abuja was accused of breach of trust, cheating and was consequently detained.

According to the FIR, on Oct 7, 2024, the defendant was entrusted with the complainant’s Honda Accord to sell at the sum of N2.2 million.

However, the defendant fraudulently sold the car to one Innocent Onuh at the sum of N1.4 million and used the money for his personal use.

During police investigation, the defendant gave a confessional statement admitting to the offence.

The offence contravened the provision of Sections 312 and 322 of the Penal Code.
