Court frees 2 herdsmen accused of criminal trespass

A Chief Magistrates’ Court in Wuse, Abuja discharged two herdsmen, Yusuf Adamu and Abdulmumin Yusuf accused of criminal trespass.

Newsextra24 reports that the police had charged the herdsmen with criminal trespass, conspiracy and mischief.

The Magistrate, Farida Ibrahim discharged them following an application by the Prosecution counsel, Mr Simpa Ibrahim to strike out the case.

The prosecution said that the complainant, Louis Demnongo decided to forgive the defendants and withdraw the matter citing, section 108(1) of the Administration of Criminal Justice Act (ACJA) to terminate the first information report.

The Magistrate therefore, struck out the case, having heard the prosecution’s application to strike out the suit and warned the herdsmen to be careful on where they take their cattle for grazing.

“The defendants are hereby discharged and the First Information Report (FIR) is withdrawn,” she said.

Earlier, the prosecution counsel told the court that the complainant had reported the matter at the Garki Police Station on Aug.9.

He said that the herdsmen criminally trespassed the complainant’s farm at Area 11, Garki , Abuja on the said date.

Ibrahim said that the herdsmen trespassed the farm with a herd of cows and they ate the complainant’s maize that was yet to be harvested.

The prosecutor said that the offence contravened the provisions of Sections 342 and 326 of the Penal Code.
