A Life Camp Magistrates’ Court in Abuja on Tuesday discharged a taxi driver, Benjamin Emineke, charged with public disturbance and causing hurt.
Chief Magistrats Musa Jobbo discharged Emineke following an application by the prosecuting counsel, Mrs Charity Nwachukwu, who prayed the court to strike out the case because the parties had settled out of court.
“Having heard the prosecution’s application to strike out the case as a result of settlement reached by both parties in the matter, the case is hereby struck out,’’ he said.
Jobbo said that the complainant had also written for the voluntary withdrawal of the matter and did not want any further trouble with the defendant.
“The First Information Report (FIR) is hereby struck out and the defendant discharged, the defendant is also discharged of all criminal charges,’’ he explained.
He warned the defendant to desist from committing any criminal acts in future
The police had changed Emineke, 30, a of Tasha Junction, Abuja with disturbance of public peace and causing hurt which he Pleaded not guilty.
Nwachukwu told the court the complainant, Mubarak Abdullahi, showed lack of interest in continuing with the prosecution.
She said that the complainant had also written for the voluntary withdrawal of the matter and did not want any further trouble with the defendant.
She said that the incident occurred on May 5, at Life Camp Junction the defendant engaged in a public fight with Abdullahi, causing him injury to the head and leg.
She said the victim was rushed to Gwarinpa General Hospital where he was treated and discharged after the incident.
Nwachukwu stated the offence contravened the provisions of Sections 113 and 244 of the Penal Code Law.
