Benue Guber: Appeal Court Reserves Judgement In Uba’s Appeal

THE appeal court in the Benue guber election case involving Hon Titus Uba and the PDP, has reserved its judgment. The case seeks to set aside the tribunal’s decision, which upheld the election of Hyacinth Alia as Governor of Benue State.

Allegations made by Uba and the PDP include the presentation of a forged certificate by Uba’s deputy, Samuel Ode, to the Independent National Electoral Commission (INEC) and the late submission of Alia’s name for the election. They also claim that Ode was not submitted to INEC after a re-run primary election.

The tribunal, however, dismissed the petition on grounds that it was a pre-election matter and was statute-barred. Uba and the PDP then appealed this judgment.

Uba and the PDP argue that their petition does not fall within the definition of a pre-election matter as provided by the constitution. They challenge the qualification of Alia and Ode to contest the governorship election in Benue State.

The lead counsel to Uba and the PDP urged the appellate court to allow the appeal and set aside the tribunal’s judgment.

The appellate court has reserved its ruling on the appeal, and the date of the ruling will be communicated to the parties involved.
